Terms and Conditions

These Terms govern your access to and use of the CAMSERMAR mobile application, website, platform, features and related services.

1. Introduction

Welcome to CAMSERMAR (Cameroon Service Market).

CAMSERMAR is a digital service marketplace designed to connect customers with independent service providers offering professional, technical, domestic, commercial and other services.

These Terms and Conditions ("Terms") govern your access to and use of the CAMSERMAR mobile application, website, platform, features and related services (collectively, the "Platform").

By creating an account, accessing, browsing or using CAMSERMAR, you confirm that you have read, understood and agreed to these Terms and any applicable policies referenced in them.

If you do not agree with these Terms, you must not use CAMSERMAR.

2. Definitions

For the purposes of these Terms:

"CAMSERMAR", "we", "us" or "our" means the operator of the CAMSERMAR platform.

"User", "you" or "your" means any person who accesses or uses CAMSERMAR.

"Customer" means a User who searches for, contacts, requests or engages a service provider.

"Service Provider" means an independent person, professional, business or organisation that advertises or offers services through CAMSERMAR.

"Platform" means the CAMSERMAR application, website, systems, databases and associated services.

"Service" means any service advertised, requested or offered through CAMSERMAR.

3. Nature of CAMSERMAR

CAMSERMAR operates primarily as a connection and discovery platform.

CAMSERMAR may allow Users to:

Discover service providers.

Search for services by category and location.

Create professional profiles.

Publish service information.

Post service requests.

Contact service providers.

Communicate through available contact or messaging features.

View ratings, reviews and portfolios.

Submit ratings and reviews.

Receive service-related information and notifications.

Unless expressly stated otherwise, CAMSERMAR does not itself provide, perform, supervise or guarantee the services offered by independent Service Providers.

A service agreement entered into between a Customer and a Service Provider is generally between those parties.

4. Eligibility

By using CAMSERMAR, you represent that:

The information you provide is accurate and not misleading.

You have the legal capacity required to enter into agreements applicable to your use of the Platform.

You will comply with applicable laws and regulations.

You will not use another person's identity or account without authorisation.

Where applicable law requires parental or guardian involvement for a person below the applicable age of legal capacity, the required consent must be obtained.

CAMSERMAR reserves the right to restrict access where eligibility cannot reasonably be established.

5. Account Registration

Certain CAMSERMAR features require an account.

When creating an account, you may be required to provide information such as:

Phone number.

Email address.

Name.

Location.

Profession or occupation.

Profile information.

Profile photograph.

Service information.

Portfolio information.

You agree to provide truthful, current and complete information.

You are responsible for maintaining the security of your account and for activity carried out through your account.

You must immediately notify CAMSERMAR if you believe that your account has been accessed or used without authorisation.

CAMSERMAR may suspend, restrict or terminate accounts containing false, fraudulent, abusive or misleading information.

6. Service Provider Responsibilities

Service Providers are independent providers and are responsible for the services they advertise.

A Service Provider must:

Provide accurate information about their services.

Use truthful photographs, qualifications and portfolio information.

Only advertise services they are legally permitted and reasonably qualified to provide.

Communicate honestly with Customers.

Honour commitments made directly to Customers.

Respect Customer privacy.

Avoid discriminatory, abusive, threatening or fraudulent behaviour.

Comply with applicable professional licensing and regulatory requirements.

A Service Provider must not falsely claim to possess qualifications, licences, certifications or professional experience.

CAMSERMAR may request additional information or documentation where verification is required.

7. Customer Responsibilities

Customers agree to:

Provide accurate service requests.

Communicate respectfully with Service Providers.

Provide accurate information necessary for the requested service.

Respect agreed appointments and arrangements.

Avoid fraudulent, abusive, threatening or unlawful behaviour.

Pay Service Providers according to agreements made directly with them, where payment is due.

Customers should independently consider the qualifications, experience, pricing and suitability of a Service Provider before engaging them.

8. No Guarantee of Service Providers

CAMSERMAR may provide profiles, ratings, reviews, portfolios, locations, categories and other information to assist Users in making their own decisions.

However, unless expressly stated otherwise, CAMSERMAR does not guarantee that:

A Service Provider is available at a particular time.

A Service Provider will complete a service.

A Service Provider's work will meet a particular standard.

A Service Provider possesses a particular qualification.

A Service Provider's information is completely accurate.

A Customer will be satisfied with a service.

A Service Provider or Customer will behave in accordance with an agreement.

Verification features, badges or other indicators provided by CAMSERMAR should not automatically be interpreted as a guarantee of the quality, legality or suitability of a service.

9. Agreements Between Customers and Service Providers

Customers and Service Providers are responsible for discussing and agreeing on matters including:

Scope of work.

Price.

Materials.

Timing.

Location.

Method of payment.

Cancellation.

Warranty or guarantee.

Other conditions applicable to the service.

CAMSERMAR is not automatically a party to agreements entered into directly between Customers and Service Providers.

Users should clearly establish important terms before work begins.

10. Payments

Unless expressly stated otherwise, CAMSERMAR does not act as the payment processor for ordinary services arranged between Customers and Service Providers.

Where CAMSERMAR introduces paid features, subscriptions, promotions or other Platform-related charges, the applicable price and conditions will be presented before payment.

Users are responsible for ensuring that payment information supplied to CAMSERMAR or an authorised payment provider is accurate.

CAMSERMAR may use third-party payment providers where applicable. Such payments may also be subject to the terms and privacy policies of the relevant payment provider.

11. Premium Features

CAMSERMAR may offer optional paid or premium features.

CAMSERMAR reserves the right to:

Introduce new premium features.

Modify existing premium features.

Change prices with appropriate notice where required.

Discontinue features.

Offer promotional pricing or discounts.

Any applicable payment, subscription, renewal or cancellation conditions will be presented to the User before purchase.

12. Ratings and Reviews

CAMSERMAR may allow Users to rate and review Service Providers.

Reviews must represent the User's genuine experience.

Users must not:

Create fake reviews.

Review themselves.

Pay or reward another person to create a misleading review.

Threaten someone to obtain or remove a review.

Post defamatory, abusive or unlawful content.

Publish another person's private information.

Manipulate ratings.

CAMSERMAR may remove, restrict or investigate reviews that violate these Terms.

Ratings and reviews represent the opinions or experiences of individual Users and do not necessarily represent the views of CAMSERMAR.

13. User-Generated Content

Users may upload or publish photographs, text, descriptions, portfolios, reviews and other content ("User Content").

You remain responsible for the User Content you submit.

By submitting User Content to CAMSERMAR, you grant CAMSERMAR a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute that content as reasonably necessary to operate, improve and promote the Platform, subject to applicable law and our Privacy Policy.

You must not upload content that:

Infringes another person's intellectual property rights.

Contains unlawful material.

Contains malicious software.

Is fraudulent or deliberately misleading.

Contains another person's private information without lawful authority.

Is abusive, threatening or discriminatory.

Promotes unlawful activities.

CAMSERMAR may remove content that violates these Terms or applicable law.

14. Prohibited Conduct

Users must not use CAMSERMAR to:

Commit fraud or deception.

Impersonate another person or organisation.

Harass, threaten or abuse another User.

Obtain another person's personal information unlawfully.

Upload malware or malicious code.

Attempt to compromise the security of the Platform.

Circumvent security or access controls.

Create accounts for fraudulent purposes.

Manipulate ratings, reviews or platform activity.

Use CAMSERMAR for unlawful purposes.

Publish misleading professional qualifications.

Use the Platform to facilitate activities prohibited by applicable law.

Scrape, copy or systematically extract Platform data without authorisation.

Interfere with the operation of CAMSERMAR.

Use another User's account without permission.

CAMSERMAR may take appropriate action where prohibited conduct is detected.

15. Safety

Users are responsible for taking reasonable precautions when meeting or engaging another User.

Customers should consider appropriate safety measures when inviting a Service Provider to a private residence or other location.

Service Providers should also take reasonable precautions when travelling to or working at a Customer's location.

For high-risk, regulated or specialised services, Users should verify relevant licences, qualifications, insurance or other requirements where applicable.

CAMSERMAR does not guarantee the personal safety, conduct or suitability of Users.

16. Emergency and Professional Services

CAMSERMAR is not an emergency response service.

The Platform must not be relied upon as a substitute for emergency services, hospitals, police, fire services or other official emergency assistance.

Where a service involves regulated professional activity, the relevant professional remains responsible for complying with applicable laws and professional standards.

17. Intellectual Property

The CAMSERMAR name, logo, branding, application design, software, graphics, text, databases and other Platform materials are owned by or licensed to CAMSERMAR unless otherwise stated.

Users may not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit CAMSERMAR's intellectual property without prior written permission, except where permitted by applicable law.

Third-party trademarks and content remain the property of their respective owners.

18. Privacy and Personal Data

CAMSERMAR may collect and process personal information necessary to provide and improve its services.

This may include information such as account details, contact information, location information, profile information, service information, communications and technical information.

CAMSERMAR will process personal data in accordance with applicable data-protection legislation and its Privacy Policy.

CAMSERMAR's processing of personal data is subject to applicable Cameroon data-protection requirements, including Law No. 2024/017 of 23 December 2024 relating to personal data protection in Cameroon.

Users should read the CAMSERMAR Privacy Policy before using the Platform.

19. Location Information

Certain CAMSERMAR features may use location information to help Users discover relevant services.

Where location permissions are required, Users may control applicable permissions through their device settings, subject to the effect this may have on Platform functionality.

Location information must not be used by Users to harass, threaten, stalk or unlawfully monitor another person.

20. Communications

By using CAMSERMAR, Users may receive service-related communications, including:

Account verification messages.

Security notifications.

Service-request notifications.

Platform updates.

Important administrative communications.

Where legally required, Users will be provided with appropriate options regarding promotional communications.

21. Third-Party Services

CAMSERMAR may integrate or link to third-party services, including communication, mapping, payment, authentication, hosting, analytics or other services.

Third-party services may have their own terms and privacy policies.

CAMSERMAR is not responsible for the independent operation, availability, policies or conduct of third-party services.

22. Availability of the Platform

CAMSERMAR aims to maintain a reliable Platform but does not guarantee uninterrupted or error-free operation.

The Platform may occasionally be unavailable because of:

Maintenance.

Updates.

Technical failures.

Internet or telecommunications problems.

Cybersecurity incidents.

Third-party service failures.

Circumstances beyond CAMSERMAR's reasonable control.

CAMSERMAR may modify, suspend or discontinue part of the Platform where reasonably necessary.

23. Disclaimers

To the maximum extent permitted by applicable law, CAMSERMAR does not guarantee that the Platform or information provided through it will always be:

Accurate.

Complete.

Current.

Available.

Secure.

Free from errors.

CAMSERMAR does not automatically inspect, supervise or control every interaction between Users.

Users are responsible for exercising appropriate judgment before entering into transactions or arrangements with other Users.

24. Limitation of Liability

To the maximum extent permitted by applicable law, CAMSERMAR shall not be responsible for losses arising solely from:

The conduct of a Customer or Service Provider.

The quality, performance or failure of an independently provided service.

Agreements made directly between Users.

Incorrect information supplied by Users.

Unauthorised actions by third parties.

Temporary Platform interruptions.

Events outside CAMSERMAR's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

25. Indemnification

To the extent permitted by applicable law, a User may be responsible for losses, claims, liabilities, damages, costs or expenses arising from:

Their violation of these Terms.

Their unlawful use of CAMSERMAR.

Their User Content.

Their infringement of another person's rights.

Their fraudulent or intentionally wrongful conduct.

Their violation of applicable laws.

26. Account Suspension And Termination

CAMSERMAR may suspend, restrict or terminate an account where reasonably necessary, including where:

These Terms are violated.

Fraud is suspected.

False information is provided.

The Platform is abused.

A User threatens the safety of others.

The User engages in unlawful activity.

The User attempts to compromise Platform security.

Where appropriate and legally permissible, CAMSERMAR may provide notice and an opportunity to resolve the issue.

Users may stop using CAMSERMAR at any time.

Termination does not automatically remove obligations or liabilities that arose before termination.

27. Reporting Abuse or Fraud

Users should report suspected:

Fraud.

Impersonation.

Fake professional credentials.

Harassment.

Threats.

Scams.

Fake reviews.

Security vulnerabilities.

Other serious violations.

CAMSERMAR may investigate reports and take appropriate action.

Users should not knowingly submit false reports against another person.

28. Disputes Between Users

CAMSERMAR encourages Customers and Service Providers to first communicate directly and attempt to resolve disputes relating to their service agreement.

Where CAMSERMAR provides a complaint or dispute-support mechanism, the Platform may review available information and take action within the scope of its role.

CAMSERMAR does not guarantee that it will resolve every dispute between Users.

Nothing in this section prevents a User from exercising legal rights available under applicable law.

29. Changes to These Terms

CAMSERMAR may update these Terms from time to time.

When material changes are made, CAMSERMAR may provide notice through the application, website, email or another appropriate method.

The updated Terms will become effective on the date indicated in the revised Terms.

Continued use of CAMSERMAR after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.

30. Governing Law

These Terms shall be interpreted in accordance with the laws applicable in the Republic of Cameroon, unless mandatory applicable law provides otherwise.

Nothing in these Terms is intended to remove or restrict rights that Users cannot legally waive.

Cameroon's legal framework includes legislation addressing electronic commerce, cybersecurity and cybercrime, consumer protection and personal-data protection.

31. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

32. Entire Agreement

These Terms, together with the CAMSERMAR Privacy Policy and any other policies expressly incorporated into them, constitute the agreement governing your use of the Platform.

34. Acceptance

By selecting "I Agree", creating an account, accessing or using CAMSERMAR, you acknowledge that:

You have read these Terms and Conditions.

You understand them.

You agree to comply with them.

You understand that CAMSERMAR primarily connects Customers with independent Service Providers.

You understand that agreements for services may be directly between Customers and Service Providers.

You agree to comply with applicable laws.
